1. Acceptance of Terms

By accessing or using Towmatic services (including AI voice agent, dispatch automation, consulting, setup, and ongoing support), you agree to be bound by these Terms & Conditions. If you do not agree, you may not use our services.

2. Services Provided

Towmatic provides:

AI-powered voice agent and dispatch automation tools

Consulting and setup services

Ongoing monthly support

Subscription access, including voice and text usage

Towmatic is not a human dispatch service and does not guarantee flawless operations.

3. Payment & Billing

All services require an upfront setup fee and monthly recurring subscription.

Monthly charges include platform access plus usage fees (calls, texts, and other usage-based charges).

Payments must be made on time. Late or defaulted payments will result in immediate cancellation of services without notice.

No partial credits will be given for cancellations mid-billing cycle.

4. Refund Policy

Towmatic maintains a strict no-refund policy. All setup fees, monthly subscriptions, and usage charges are non-refundable under all circumstances.

5. User Responsibilities

Clients (tow companies) are responsible for:

Providing accurate and up-to-date information on pricing, driver schedules, ETAs, and phone routing preferences.

Monitoring calls, quotes, and dispatches for accuracy.

Ensuring compliance with local, state, and federal laws in use of the service.

Towmatic is not liable for errors caused by inaccurate or outdated client-provided information.

6. Disclaimers & Limitation of Liability

Towmatic does not guarantee uninterrupted service or error-free performance. By using our services, you acknowledge and agree that:

Towmatic is not liable for missed jobs, incorrect dispatching, system outages, misheard instructions, misinterpretations, incorrect distance or quote calculations, or any other error.

Towmatic is a tool to assist your business, but ultimate responsibility for operations, compliance, and accuracy rests with you.

In no event shall Towmatic be held liable for indirect, incidental, or consequential damages, including lost profits or missed opportunities.

7. Termination & Suspension

Clients may cancel at any time. If cancelled, services remain active until the end of the paid month.

Towmatic may suspend or terminate services immediately if a client:

Fails to pay

Misuses the system

Attempts to resell or replicate Towmatic technology

Violates any applicable laws or these Terms

Towmatic reserves the right to pursue legal action for unpaid fees or misuse.

8. Intellectual Property

All technology, processes, and content provided by Towmatic remain the sole property of Five Star Automations LLC. Clients may not copy, resell, reverse-engineer, or exploit the system.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Kansas, USA. Any disputes shall be resolved exclusively in the state or federal courts located in Kansas.

10. Amendments

Towmatic reserves the right to update or amend these Terms & Conditions at any time. Continued use of services after changes constitutes acceptance.
